我的哈佛故事

貴報二月十九日刊出英九回應陳重信立法委員所撰「哈佛故事」的投書後,陸續又有讀者回應,要求公布英九與孔傑榮教授往來書信的原件,並提出若干質疑。英九除感謝其指教外,亦覺有必要澄清其中某些臆測之詞,避免以訛傳訛。茲說明如下:

一、英九是在一月十一日以電子郵件向孔教授說明陳委員的投書內容,詢問有無需要加以澄清之處,孔教授便以紐約大學之信紙具名回函說明其立場,嗣獲其同意刊諸報端,因顧慮篇幅較長,故未附原文。英九甫藉孔教授近日來訪之機會,當面再洽獲其同意公布原函,茲附上往來信件各一,盼藉貴報一隅公開,以昭公信。

二、英九在去函中完全未提及內人,並無所謂『孔教授是在回答馬英九先生「提引式」的問話』。而孔教授於回函中提到內人,或係因為英九在哈佛大學博士班就讀時,內人也在孔教授主持的東亞法學研究中心擔任研究助理,負責為孔教授蒐集有關臺灣人權及法治的資料,並深獲其肯定所致。

三、孔教授是英九初進哈佛大學法學院博士班之指導教授之一,後雖因其經常赴中國大陸研究法律問題,改由其他教授指導,然多年來孔教授與英九常保聯繫,始終維持亦師亦友的關係,此所以英九絕不相信孔教授曾有陳重信委員所述之發言,此亦為孔教授願意出面具名說明其立場之原因。

四、英九在哈佛大學法學博士論文題目為「Trouble over Oily Waters : Legal Problems of Seabed Boundaries and Foreign Investments in the East China Sea」,其基本資料載於哈佛大學的網站(http://hollis.harvard.edu),全文應可透過學術機構的網路獲得。該文研究的主題仍是法律問題,並非主要是『「石油與海洋地質」的研究』,其中有關劃界問題及島嶼問題的部分後來都成為專書,分別是英文的「Legal Problems of Seabed Boundary Delimitation in the East China Sea (Baltimore: University of Maryland, 1984, 308頁)」以及中文的「從新海洋法論釣魚臺列嶼與東海劃界問題(台北:正中書局,民國75年,266頁)」,前者曾獲多篇學術論文引用,且有其他學者撰寫書評,刊於「中國季刊」(The China Quarterly, No. 108, Dec., 1986)及「社會主義法律評論」(Review of Socialist Law, No. 4, 1987)等期刊,其學術價值應有公評。

對於各界的批評,倘屬確實,英九一定虛心接受,然為避免積非成是,實有必要呈現真相,誠盼謠言就此平息。

Dear Professor Cohen:

I am writing regarding a troublesome comment about me, which also concerns you, recently made by Mr. Winston Chen, a DPP Legislator and a Harvard alumnus who seems to know you.

The latest account refers to Mr. Chen’s Letter to the Editor, published on January 9, 2006 in the Liberty Times. Mr. Chen recalls an event, in the afternoon of February 6, 1978, when Mr. Kuo Yu-shin, one of the pioneers of Taiwan’s democracy movement, was to deliver a speech at Harvard Law School. While Mr. Chen, Ms. Annette Lu and you waited for Mr. Kuo’s arrival, Mr. Chen said he mentioned a news report on the KMT’s spies incident on MIT campus. At that time, seeing me walking into the building, Mr. Chen quoted you as saying “Winston, there is another KMT spy coming.”

Mr. Chen even went so far as to add that he, out of curiosity, had made a phone call to you in 1998, exactly 20 years after the occasion, asking you the reason you labeled me as a “KMT spy” on that day. You answered, according to his account, that you knew it because some Harvard students had told you so. (1998 was the year I ran for Taipei mayorship. During the campaign, Ms. Annette Lu also made similar unfounded accusations against me. )

This is not the first time Mr. Chen has taken this issue against me and I appreciate it very much that you have previously responded to my inquiry, when we talked over the phone in 1998, by clarifying that what he has to say is unfounded. You asked me why Ms. Annette Lu did this to me who had helped get her out of jail in March, 1986. It is foreseeable that in the future this kind of hearsay will emerge whenever Mr. Chen feels like bringing it up. I personally feel uncomfortable and think it is unfair to you that he not only involves you in his speculation, but makes it public without your knowledge. Please kindly drop me a note if you need me to settle this issue and make some kind of clarification.
